By applying for, accessing, downloading, installing, or using a beta version of GrailLocker™ (the “Beta App”), you agree to this Beta Tester Agreement (“Agreement”). If you do not agree, do not participate in the beta program.
1. Purpose of the Beta
GrailLocker™ is prerelease software. The beta program exists to evaluate functionality, usability, performance, accuracy, reliability, and overall experience before public release. You understand that the Beta App may contain bugs, incomplete features, inaccurate information, crashes, or other problems normally associated with prerelease software.
2. Eligibility
Beta participants must be at least 13 years old. Participants under 18 must have approval from a parent or legal guardian who has reviewed and agreed to this Agreement. Participation through Apple TestFlight is also subject to Apple’s applicable age and account requirements. Participation is voluntary and access may be limited, suspended, or terminated at any time.
3. Limited Beta License
GrailLocker™ grants you a limited, personal, revocable, non exclusive, non transferable license to use the Beta App solely for testing and evaluation. You may not sell, sublicense, redistribute, copy, reverse engineer, decompile, modify, or commercially exploit the Beta App except where such restrictions are prohibited by applicable law.
4. Confidentiality
The Beta App may contain unreleased features, designs, interfaces, technology, pricing systems, workflows, business information, and other non public information. Unless GrailLocker™ gives permission, you agree not to publicly disclose confidential or non public aspects of the Beta App, including screenshots, screen recordings, videos, detailed feature descriptions, or other confidential beta materials. Information GrailLocker™ has intentionally made public is not confidential solely because it also appears in the Beta App.
5. Feedback
You may voluntarily provide comments, bug reports, suggestions, ideas, feature requests, screenshots, or other feedback. By submitting feedback, you give GrailLocker™ permission to use, reproduce, modify, incorporate, and otherwise use that feedback to develop, improve, market, or operate GrailLocker™ without compensation or obligation to you.
6. Trading Card Values and Market Information
GrailLocker™ may provide estimated values, trends, deal analysis, trade analysis, collection values, purchase references, sale references, or similar information. All such information is provided for informational and entertainment purposes only. Trading card values can change rapidly and vary based on condition, grading, authenticity, rarity, demand, location, fees, venue, and other factors.
GrailLocker™ does not guarantee the accuracy or completeness of any estimated value, that a card can be purchased or sold for a displayed amount, the accuracy or availability of third party market data, or the profitability of any purchase, sale, trade, or collecting decision. You remain responsible for your own decisions. GrailLocker™ is not providing financial, investment, appraisal, authentication, or professional trading advice.
7. Card Identification and Grading Information
Features that scan, identify, recognize, categorize, grade, price, or otherwise analyze trading cards may occasionally produce incorrect or incomplete results. Independently verify important information including card identity, year, set, number, variant, parallel, grade, certification number, authenticity, and market value before completing a transaction.
8. Beta Software Disclaimer
The Beta App is provided “AS IS” and “AS AVAILABLE” to the fullest extent permitted by law. Features may be added, removed, redesigned, disabled, or changed without notice. Information stored within the Beta App may be lost, reset, modified, or deleted during testing. Do not rely on the Beta App as the sole permanent record of important collection or transaction information during beta.
9. Third Party Services
GrailLocker™ may interact with third party APIs, databases, marketplaces, grading companies, pricing providers, websites, or other services. Those services may become unavailable, change their information, restrict access, or provide inaccurate or incomplete information. GrailLocker™ does not control independent third party services.
10. Privacy and Beta Data
Participation may involve collection of information necessary to operate, test, secure, troubleshoot, and improve GrailLocker™. Our handling of personal information is described in the GrailLocker™ Privacy Policy.
11. TestFlight
The Beta App may be distributed through Apple TestFlight. Your use of TestFlight is also subject to Apple’s applicable terms and policies. Beta builds may expire, become unavailable, or be replaced. Beta participation does not guarantee access to a final version or any future feature.
12. No Compensation
Unless GrailLocker™ expressly agrees otherwise in writing, beta participation is voluntary and unpaid. Participation does not make you an employee, contractor, partner, representative, or agent of GrailLocker™.
13. Intellectual Property
GrailLocker™ and its associated software, source code, branding, logos, graphics, interfaces, designs, features, documentation, and other original materials are owned by GrailLocker™ or applicable licensors. Nothing in this Agreement transfers ownership to you.
14. Termination
You may stop participating at any time. GrailLocker™ may suspend or terminate beta access at any time, including for violation of this Agreement or misuse of the Beta App. Provisions concerning confidentiality, intellectual property, feedback, disclaimers, and other terms that by their nature should survive termination will continue to apply.
15. Limitation of Liability
To the fullest extent permitted by applicable law, GrailLocker™ and its owners, operators, developers, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or similar damages arising from beta participation or use of the Beta App, including losses related to inaccurate card information, valuations, transactions, data loss, interrupted access, software errors, or reliance on beta functionality. Nothing excludes liability that cannot legally be excluded.
16. Changes to the Beta or Agreement
Because GrailLocker™ is actively being developed, the Beta App and this Agreement may change. If material changes are made, testers may be asked to review and accept updated terms before continuing.
17. Governing Law
To the extent permitted by applicable law, this Agreement is governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
18. Entire Agreement
This Agreement, the GrailLocker™ Privacy Policy, and applicable TestFlight or platform terms constitute the agreement concerning beta participation. If a provision is unenforceable, remaining provisions remain in effect.
19. Acceptance
By selecting the acceptance checkbox, submitting a beta application, accepting beta access, or using the Beta App after being presented with this Agreement, you acknowledge that you have read, understood, and agreed to it.
